New Delhi: The AAP on Saturday said the Centre’s ordinance on transfer of bureaucrats in Delhi is ‘unconstitutional’ and a move to usurp the powers given to the Delhi government by the Supreme Court in service matters. Addressing a press conference, Delhi minister Atishi said the Center deliberately decided to bring the ordinance at a time when the Supreme Court is closed for summer vacation.
The Center on Friday promulgated an ordinance to create the National Capital Civil Services Authority for transfer and disciplinary proceedings against Group-A officers of DANICS cadre.
This comes a week after the Supreme Court handed over services in Delhi to the elected government except those relating to police, public order and land.
Atishi said the Centre’s ordinance shows that “Prime Minister Narendra Modi is scared of Chief Minister Arvind Kejriwal” and the power of honest politics.
“They are scared that if he (Kejriwal) gets power, he will do extraordinary things for Delhi. The ordinance is an attempt to usurp the power given to the AAP government by the apex court on May 11,” he said. The minister said that even if the people of Delhi have voted for Kejriwal, this ordinance says that he will not run Delhi. He said the ordinance is “unconstitutional” and will be struck down by the Supreme Court.
“The Center deliberately decided to bring this ordinance last night. The Supreme Court has closed for vacation for six weeks and this is a deliberate attempt to obstruct the work,” he alleged. Atishi said that the Supreme Court has given powers to the Delhi government after an eight-year-long battle.
“But the Center could not afford it. The Ordinance provides for the creation of a National Capital Civil Services Authority with three members – the CM as its chairman and the chief secretary and principal home secretary as its members. But it must be noted that That the Chief Secretary and Principal Home Secretary will be appointed by the Centre.
“The authority will take decisions by majority vote. It means that decisions will be taken by the bureaucrats of the Centre. If it takes any decision which the Center does not like, the LG will have the right to overturn the decision,” he added.
