Lucknow: The Lucknow bench of the Allahabad High Court has said that any sexual, sensual, affectionate act like kissing, touching, staring etc. before marriage is prohibited in Islam. The court dismissed a petition filed by an interfaith live-in couple seeking protection against alleged harassment at the hands of the police.
A bench of Justice Sangeeta Chandra and Justice Narendra Kumar Johri said that no recognition can be given to extramarital sex in Muslim law.
Zina is defined as any sexual intercourse other than between husband and wife, includes both sex outside marriage and premarital sex, and is often translated in English as fornication. This type of premarital sex is not allowed in Islam. In fact, any sexual, sensual, affectionate act like kissing, touching, staring etc. before marriage is ‘haram’ in Islam, the bench said.
The bench was hearing a security plea filed by an inter-faith couple alleging that the woman’s mother was unhappy with their live-in relationship and had lodged an FIR against them.
The couple cited the Supreme Court judgment on live-in relationships to seek protection against alleged harassment by the police. On this, the bench said that the views expressed by the Supreme Court on live-in relationships cannot be considered to promote such relationships.
“The law has traditionally been biased in favor of marriage. It reserves several rights and privileges to married persons in order to preserve and encourage the institution of marriage. The Supreme Court is merely acknowledging a social reality and its Indian There is no intention to expose the fabric of family life,” the bench said.
